Basketball presents certain inherent risks and hazards, which the player-participant assumes, and parent/guardian is urged to consider. To the best of my knowledge, there are no physical or other health-related conditions, which will interfere with my child’s participation unless noted. I understand and acknowledge that such recreational activities have inherent risks, dangers and hazards (foreseeable and unforeseeable), that may result in injury, illness, or property damage, and on behalf of myself, my family, agents and contractors, I hereby release and agree to hold harmless Finesse Basketball Academy, its sponsors, coaches, managers, administration, etc. from all claims, actions, or losses related thereto. Finesse Basketball Academy assumes no liability for injury or damage arising from the results of participation of the above Player unless due to willful fault or gross negligence on the part of Finesse Basketball Academy.
I understand that I am responsible for my child’s medical coverage. To the best of my knowledge, my child is in good health and physically able to participate in an active sports program. In the case of an emergency and we are not available for immediate consultation, I hereby give permission to Finesse Basketball Academy and any emergency medical respondents to take necessary measures for the safety and health of my child. I have disclosed all pertinent medical information regarding prescription medications and allergies.
By signing this waiver, I authorize the use of videos or pictures of the above-named participant to be posted on the Finesse Basketball Academy social media accounts or advertising media published by Finesse Basketball Academy.
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, provincial, and local governments and federal and provincial health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. The Finesse Basketball Academy (“the Club”) has put in place preventative measures to reduce the spread of COVID-19; however, the Club cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, participating in training sessions could increase your risk and your child(ren)’s risk of contracting COVID-19.
By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by participating in training and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at the training may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Club employees, contract workers, volunteers, and program participants and their families.
I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance at the Club or participation in Club programming (“Claims”).
On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless the Club, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of the Club, its employees, agents, contract workers and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Club program.
